Terms of service
TSAVALAS TERMS
Terms of Service
Effective: 2025
OVERVIEW
Welcome to Tsavalas. By using this website and related services (the “Services”) you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you don’t agree, please don’t use the Services.
1. Access & Account
You confirm you’re at least the age of majority in your country (or have guardian consent). Keep your login safe—you’re responsible for activity under your account.
2. Our Products (handmade & made-to-order)
We handcraft with natural leather. Minor variations in color/texture are normal. Screen colors can differ. We may update or discontinue products and limit quantities per customer/region.
3. Orders
Submitting an order is an offer to buy. We accept it by confirming and processing payment; if we can’t accept, we’ll cancel and refund.
Made-to-order: production often starts quickly. After acceptance, cancellation may not be possible. Returns/exchanges follow our Returns Policy. Purchases are for personal use only (no resale without permission).
3A. EU right of withdrawal (14 days)
If you are an EU consumer, you may withdraw from an online purchase within 14 calendar days of delivery without giving any reason, provided items are unused and in original condition/packaging.
Exceptions: personalized/engraved goods and other lawful exceptions don’t have a change-of-mind right. To withdraw, email hello@tsavalas.com within 14 days and return the goods promptly after our reply. Unless the item is faulty/misdescribed, you are responsible for return shipping. This is in addition to your legal guarantee rights.
4. Prices & Billing
Prices may change without notice. The price shown at checkout applies. Unless stated otherwise, prices exclude taxes, duties, and shipping. You authorize us to charge your selected payment method for the order total (including applicable taxes/fees) and you’ll provide accurate billing/contact info.
EU price reductions: when we announce a discount, we will show the prior lowest price applied to the product in the preceding 30 days, as required by law.
5. Shipping & Delivery
Lead times and delivery windows are estimates. We’re not liable for delays caused by carriers, customs, weather, or events outside our control. See our Shipping Policy for methods and typical transit times.
EU consumer law: risk of loss passes to you when the goods are delivered to you (or your nominated person). If a parcel arrives damaged or missing items, contact us promptly with photos so we can help.
6. Intellectual Property
All content on the Services (text, photos, graphics, logos, videos, designs) is owned by Tsavalas or its licensors and protected by IP laws. Don’t copy, modify, distribute, or use our content without written permission.
7. Optional Tools & Third-Party Links
We may offer third-party tools or link to third-party sites. They’re provided “as is.” Use them at your discretion and review their terms and privacy policies.
8. Privacy
We process personal data as described in our Privacy Policy. We use third-party service providers to operate the store and some data may be processed outside your country.
9. Feedback & Reviews
If you post a review or send suggestions (“Feedback”), you grant us a worldwide, royalty-free license to use and display it (e.g., on our site or social media). You confirm you own the Feedback and it doesn’t infringe others’ rights or include unlawful content.
Reviews authenticity: if we display customer reviews, we disclose whether/how we verify that reviews come from real purchasers, and we do not suppress negative reviews or use fake/incentivized reviews.
10. Errors, Inaccuracies, Omissions
Occasionally information may contain errors (e.g., pricing/availability). We may correct or update and may cancel orders affected by an obvious error (with a refund).
11. Prohibited Uses
Don’t use the Services to violate laws, harass others, send spam/malware, scrape our site, attempt to hack, or infringe IP rights. We may suspend or terminate access for violations.
12. Termination
We can suspend or terminate access if you breach these Terms. Sections that by nature survive (IP, Feedback, Warranty/Liability, Indemnity, Governing Law, etc.) continue after termination.
13. Disclaimer of Warranties
Except as required by mandatory consumer law, the Services and products are provided “as is” and “as available.” We don’t guarantee error-free or uninterrupted operation.
14. Limitation of Liability
To the fullest extent permitted by law, we’re not liable for indirect or consequential losses (like lost profits or data) arising from use of the Services or products. Nothing here limits your non-waivable consumer rights.
14A. Legal guarantee (EU – 1 years)
For EU consumers, products are covered by a 1-year legal guarantee of conformity. If a lack of conformity appears within 2 years of delivery, you are entitled—free of charge—to repair or replacement, or if impossible or disproportionate, a price reduction or refund, as required by law. This section does not limit any mandatory rights.
15. Indemnification
You agree to indemnify and hold harmless Tsavalas from third-party claims arising from your breach of these Terms or unlawful use of the Services.
16. Severability
If any part of these Terms is unlawful or unenforceable, the rest remains in effect.
17. Waiver & Entire Agreement
Our failure to enforce a right isn’t a waiver. These Terms (plus policies linked here) are the entire agreement between you and us about the Services.
18. Assignment
You can’t assign your rights under these Terms without our consent. We may assign our rights and obligations.
19. Governing Law & Jurisdiction
These Terms are governed by the laws of Greece (without regard to conflict-of-law rules). Courts of Athens have exclusive jurisdiction, subject to any mandatory consumer rights.
Dispute resolution: for guidance on consumer dispute resolution in the EU, see the European Commission’s Consumer Redress in the EU page or your national ADR body.
20. Changes to Terms
We may update these Terms from time to time. We’ll post the new version with the effective date. If required by law, we’ll notify you of material changes. Continued use means you accept the changes.
